Welcome to Divine POS, the premier rental POS software developed by Micton Web Design Inc. (“we”, “us”, “our”) designed to streamline your business operations. We grant you a non-exclusive, non-transferable license to use Divine POS software (“Software”) for your business purposes subject to the terms and conditions set forth herein. This license does not grant you any rights to sell, redistribute, or modify the Software without our prior written consent.

2. Fees and Payment

You agree to pay all fees associated with your subscription to our services as outlined in our pricing plan available on our website. Payment terms, including due dates, methods of payment, and consequences of late payments, are detailed in our pricing plan and subscription agreement.

3. Use of the Service

You agree to use the Software solely for lawful business operations and in accordance with all applicable laws and regulations. You shall not use the Software for any illegal purpose or in any manner that could damage, disable, overburden, or impair the Software or interfere with any other party’s use and enjoyment of the Software.

4. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Micton Web Design Inc. or its affiliates, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Software.

5. Termination

We reserve the right to terminate or suspend your license and access to our services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms. Upon termination, your right to use the Software will cease immediately.

6. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Software after those revisions become effective, you agree to be bound by the revised terms.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. We welcome users from all over the world, but Divine POS is operated from Canada.
